Terms of Service

1. Overview of the Service
Rushkit is a desktop application and associated services operated by PynchLabs that helps video professionals manage media offloading, proxy generation, AI-powered slate detection, and NLE integration. Rushkit does not host, edit, or distribute your footage — it runs locally on your machine with optional cloud integrations.
2. Eligibility
You must be:
- At least 18 years old
- Legally able to enter agreements
- Using Rushkit for professional or personal creative purposes
3. Account Registration
To use certain features, you must create an account and provide accurate information. You are responsible for:
- Keeping login credentials secure
- Activities occurring under your account
- Updating your details when they change
We may refuse or revoke accounts at our discretion.
4. Use of the Platform
You agree not to:
- Use Rushkit to process, store, or transmit illegal content
- Engage in fraud, harassment, or abusive behavior
- Upload malware, harmful code, or prohibited content
- Scrape, index, or reverse engineer our systems
- Attempt to access another user's data
- Redistribute, sublicense, or resell Rushkit without authorization
Violation may result in account suspension or termination.
5. Your Data
Rushkit processes your media files locally on your device. Your footage, metadata, and project data remain under your control. We do not:
- Upload your footage to our servers (unless you configure cloud backup)
- Train AI models on your content
- Access your files without your explicit action
Cloud features (backup to S3, Google Drive, etc.) are initiated by you and connect directly to your own storage accounts.
6. Fees and Payments
Rushkit offers Solo, Pro, and Team pricing tiers. Pricing is listed at rushkit.app.
- All plans include a 14-day free Pro trial. No credit card required.
- Annual and monthly billing options are available.
- PynchLabs reserves the right to modify pricing with reasonable notice. Continued use after notification constitutes acceptance of updated pricing.
Payments are processed by Stripe. PynchLabs does not store your payment card details.
7. Third-Party Services
Rushkit integrates with: Vercel (hosting), Turso (database), Resend (email delivery), Stripe (payment processing). These providers act as processors and do not own your data. Your use of these components is subject to their respective terms.
8. AI & Automated Features
Rushkit offers AI-assisted features including slate detection and metadata extraction. These features process data locally on your device. We do not:
- Train external models on your data
- Send user footage to external AI vendors for model training
- Provide guarantees about AI output accuracy
AI outputs are informational only. You are responsible for verifying any AI-generated metadata before committing it to your project.
9. Termination
We may suspend or terminate your access to Rushkit if you violate these Terms, harm platform integrity, or engage in abusive behavior. You may request account deletion at any time. Upon termination, you may request an export of your data.
10. Disclaimers
Rushkit is provided “as is” and “as available.” We disclaim all warranties, express or implied, including but not limited to: merchantability, fitness for a particular purpose, non-infringement, availability or uptime, and accuracy of AI-generated metadata.
Media integrity verification (checksums) is a tool to assist your workflow. Ultimate responsibility for data integrity rests with you.
11. Limitation of Liability
To the fullest extent permitted by law:
- PynchLabs is not liable for any damages arising from data loss during offloading, even if checksums were used.
- PynchLabs is not liable for AI-generated metadata that is incorrect.
- PynchLabs's total liability for any claim will not exceed the greater of $100 or the amount paid by you to PynchLabs in the previous 12 months.
You agree to indemnify PynchLabs against claims arising from your use of the platform or content you process through it.
12. Governing Law & Dispute Resolution
- Governing Law: These Terms are governed by the laws of the State of Delaware.
- Arbitration: Any dispute will be resolved through binding arbitration, except that either party may pursue claims in small claims court. Arbitration will be administered by the American Arbitration Association (AAA) under its Commercial Arbitration Rules.
13. Changes to These Terms
We may update these Terms from time to time. If changes are material, we will notify users via email or in-app notices. Continued use of Rushkit after changes constitutes acceptance.
